The most recent case is in Brazil, where a judge in that country has long questioned Apple’s reasoning for removing the accessory and is forcing the company to compensate a customer of $1,075 for the missing charger. .

Eliminate the charger: a measure impossible to implement in Brazil

According to article 39 of the Brazilian Consumer Code, this type of sales in which accessories are sold separately is prohibited as it is considered an abusive practice. This means that it is not allowed to sell the mobile and the charger separately and this is the basis on which the Brazilian judge is sentencing the company with this compensation.

The amount established for the sanction is 5,000 reais , which is the equivalent of more than a thousand US dollars, as a sanction for continued sales of the same product, that is, selling equipment and the mandatory accessories to make it work. are sold separately.

This would be a new sanction that Apple receives in Brazil. In 2021, the company was fined two million dollars as punishment for violating consumer law and disrespecting customers in its country. And it is that according to the Consumer Protection Institute, the charger is an “essential part” of the smartphone experience.
